Cintiq Pro 13 - Huge issue with stylus

Hi, I purchased a Cintiq Pro 13 last week and I'm having major issues with the stylus.

Everything works fine except for the stylus. I have a macbook pro 2015 with latest OSX Sierra and tablet is being connected through mini display port.
The touch function works perfect, I had no installation issues EXCEPT for the stylus that keeps on moving itself upwards and downwards. I tried installing latest Wacom drivers, 6.3.20 and 6.3.21 and nothing seems to fix it. I have an old Intuos 4 tablet and I also tried the stylus but the result is the same.

My main issue is that I purchased this tablet in Japan and I have no way of going back to the store to exchange it. Does this look like a major hardware issue or is there a possibility of this being a driver issue that can be fixed with an update?

I'm so frustrated because I saved money for years to buy a cintiq and went for the newer model instead of the 13 HD, I feel like I wasted 1000 USD on something I'll never be able to use... any help will be greatly appreciated :(
